Eduskunnan päätöksen mukaisesti muutetaan tullilain (304/2016) 9 luvun otsikko ja 61 § seuraavasti:
9 luku – Tulliverotuksen toimittaminen ja Tullin asiakirjojen tiedoksianto
61 §Tiedoksianto
Tullin määrää, sen oikaisua tai tavaran tulliselvitykseen liittyvää virhemaksua koskeva Tullin päätös ja muu tiedoksi annettava asiakirja annetaan asianosaiselle tai muulle muutoksenhakuun oikeutetulle (Tullin asiakas ) tiedoksi tavallisena tiedoksiantona.
Tulli voi antaa 1 momentissa tarkoitetun ja muun päätöksen ja asiakirjan Tullin asiointipalvelussa sähköisesti tiedoksi, jos Tullin asiakas on
1) laittanut asian vireille Tullin asiointipalvelussa;
2) Tullin vireille laittamaa asiaa varten antanut Tullille sähköisen yhteystiedon tiedoksiannosta tehtävän ilmoituksen lähettämistä varten; tai
3) hallinnon yhteisistä sähköisen asioinnin tukipalveluista annetun lain (571/2016) 3 §:n 1 momentin 7 kohdassa tarkoitetun viestinvälityspalvelun käyttäjä.
Tulli ilmoittaa Tullin sähköiseen asiointipalveluun lähetetystä tiedoksi annettavasta asiakirjasta sen vastaanottajalle. Ilmoitus lähetetään hallinnon yhteisistä sähköisen asioinnin tukipalveluista annetun lain 3 §:n 1 momentin 7 kohdassa tarkoitettuun viestinvälityspalveluun.
Jos viestinvälityspalvelu ei ole vastaanottajalla käytössä, 3 momentissa tarkoitettu ilmoitus lähetetään tämän Tullille nimenomaisesti ilmoituksen lähettämistä varten ilmoittamaan sähköiseen osoitteeseen tai tämän muutoin Tullille ilmoittamaan sähköiseen yhteystietoon. Ilmoitusta ei kuitenkaan lähetetä, jos vastaanottaja on kieltänyt ilmoituksen lähettämisen. Ilmoitusta ei myöskään lähetetä, jos Tullilla ei ole vastaanottajan sähköistä osoitetta tai muuta sähköistä yhteystietoa. Tullin on annettava asiakkaalle sähköisessä asiointipalvelussa tieto siitä, että ilmoitusta ei lähetetä, jos tämä ei ole ilmoittanut Tullille sähköistä osoitetta tai muuta sähköistä yhteystietoa ilmoituksen lähettämistä varten.
Tulli antaa asiakkaan pyynnöstä päätöksen ja muun asiakirjan tälle tiedoksi kirjeellä, jos asiakkaalla ei ole käytössä hallinnon yhteisistä sähköisen asioinnin tukipalveluista annetun lain 3 §:n 1 momentin 7 kohdassa tarkoitettua viestinvälityspalvelua.
Tulli antaa päätökset ja muut asiakirjat sanomamuotoista sähköistä tiedonsiirtomenetelmää käyttävälle Tullin asiakkaalle tiedoksi vastaussanomalla. Asiakkaan katsotaan saaneen päätöksestä ja muusta asiakirjasta tiedon kolmantena päivänä siitä, kun vastaussanoma on tullut asiakkaan saataville Tullin tietojärjestelmässä, jollei muuta näytetä.
Silloin kun tavallista tiedoksiantoa ei toimiteta sähköisesti, Tulli antaa päätöksen ja muun asiakirjan tiedoksi kirjeellä. Jollei muuta näytetä, vastaanottajan katsotaan saaneen päätöksestä ja muusta asiakirjasta tiedon:
1) sen vahvistamispäivänä, jos se on annettu asiakkaalle;
2) kahdeksantena päivänä sen vahvistamispäivästä, jos se on annettu postin kuljetettavaksi.
Tullin päätösten ja muiden asiakirjojen tiedoksiannosta tullirikostorjunnan tehtävissä säädetään erikseen.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
