Laki kalastuslain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan kalastuslain (379/2015) 10 §, ja lisätään lakiin siitä lailla 997/2016 kumotun 119 §:n tilalle uusi 119 § seuraavasti:
10 §Oikeus Ylä-Lapin kalastuslupaan
Henkilöllä, jonka kotikuntalain (201/1994) 2 §:ssä tarkoitettu kotikunta on Enontekiö, Inari tai Utsjoki, on oikeus saada Metsähallitukselta korvauksetta lupa kalastukseen edellä mainituissa kunnissa sijaitsevilla valtiolle kuuluvilla vesialueilla. Lupa on henkilökohtainen ja se annetaan enintään kolmeksi vuodeksi kerrallaan.
Edellä 1 momentissa tarkoitettu lupa ei koske Teno-, Näätämö-, Tuuloma-, Paats-, Tornion- eikä Ounasjoen vesistöjen lohen eikä taimenen nousualueita. Näillä alueilla 1 momentissa tarkoitetulla henkilöllä on oikeus lunastaa Metsähallitukselta henkilökohtainen kausilupa, joka oikeuttaa Metsähallituksen asettamien lupaehtojen puitteissa viehekalastukseen henkilön kotikunnassa sijaitsevilla valtiolle kuuluvilla lohen sekä taimenen nousualueilla. Metsähallituksen kausiluvalle asettamat lupaehdot, joita ovat kalastajakohtaiset saaliskiintiöt, saaliin raportointivelvollisuus sekä muut yleiset ja lupa-aluekohtaiset kalastusrajoitukset, vahvistetaan kausiluvassa. Luvasta peritään maksu, jonka suuruudesta säädetään valtion maksuperustelaissa (150/1992) ja sen nojalla. Alle 18-vuotiaille kausilupa on maksuton.
Edellä 2 momentissa tarkoitetuilla lohen sekä taimenen nousualueilla tapahtuvasta kalastuksesta osa varataan myönnettäväksi Metsähallituksesta annetun lain 18 §:n 2 momentissa tarkoitettuina aluekohtaisina kalastuskiintiöinä.
Tarkempia säännöksiä tässä pykälässä tarkoitettujen lupien myöntämisestä ja käytöstä voidaan antaa maa- ja metsätalousministeriön asetuksella.
119 §Menettämisseuraamus
Se, joka on syyllistynyt tämän lain 118 §:n 1 momentin 1—3, 5 tai 6 kohdassa taikka rikoslain 48 a luvun 2 §:n 1 momentin 1 tai 2 kohdassa tarkoitettuun muuhun tekoon kuin tämän lain 59 tai 60 §:n nojalla tehdyn kalastuskiellon tai -rajoituksen rikkomiseen, ja ottanut saaliiksi lohen, järvilohen, ankeriaan, nahkiaisen, taimenen, harjuksen, nieriän, jokiravun tai mereen laskevassa joessa tai purossa olevan siian, on tuomittava menettämään valtiolle arvo, joka sillä lajinsa edustajana on. Menettämisseuraamuksista säädetään lisäksi rikoslain 10 luvussa.
Maa- ja metsätalousministeriön asetuksella säädetään mainittujen lajien määritetyistä yksiköistä ja niille vahvistettavista arvoista.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
