Eduskunnan päätöksen mukaisesti lisätään terveydenhuoltolakiin (1326/2010) uusi 45 a § seuraavasti:
45 a §Leikkaustoiminta ilman yhteispäivystystä
Sen estämättä, mitä 45 §:n 3 momentissa säädetään, sairaanhoitopiiri voi järjestää anestesiaa ja leikkaussaliolosuhteita edellyttävää kiireetöntä leikkaustoimintaa tai yleisanestesiaa edellyttäviä muita kiireettömiä toimenpiteitä sairaanhoitopiirin toimintayksikössä, jossa ei ole 50 §:n 3 tai 4 momentissa tarkoitettua ympärivuorokautista perusterveydenhuollon ja erikoissairaanhoidon yhteispäivystystä, edellyttäen, että asiasta on sovittu erikoissairaanhoidon järjestämissopimuksessa. Sairaanhoitopiirin kuntayhtymä voi myös hankkia edellä mainittua leikkaustoimintaa tai toimenpiteitä muulta palveluntuottajalta tai antaa niihin palvelusetelin. Tällöin anestesiaa ja leikkaussaliolosuhteita edellyttävää kiireetöntä leikkaustoimintaa tai yleisanestesiaa edellyttäviä muita kiireettömiä toimenpiteitä tekevien yksiköiden on varmistettava päivystysvalmius sekä toiminnan laatu ja potilasturvallisuus, riittävä osaaminen, henkilöstö ja toimenpiteiden määrä sekä sovittava mahdollisuudesta siirtää potilas nopeasti jatkohoitoon sairaalaan, jossa on ympärivuorokautinen valmius päivystysleikkausten tekemiseen, teho-osasto ja riittävän laajasti erikoisalojen ympärivuorokautista päivystystä.
Valtioneuvoston asetuksella annetaan tarkempia säännöksiä 1 momentissa tarkoitetussa anestesiaa ja leikkaussaliolosuhteita edellyttävässä kiireettömässä leikkaustoiminnassa ja yleisanestesiaa edellyttävissä kiireettömissä toimenpiteissä edellytettävästä päivystysvalmiudesta sekä toimenpiteiden riittävästä laadusta ja määrästä, potilasturvallisuuden varmistamisesta, tarvittavasta osaamisesta ja henkilöstöstä sekä muista potilasturvallisuuden edellyttämistä seikoista. Lisäksi valtioneuvoston asetuksella annetaan tarkempia säännöksiä sopimuksen sisällöstä, jossa sovitaan mahdollisuudesta siirtää potilas nopeasti jatkohoitoon sairaalaan, jossa on ympärivuorokautinen valmius päivystysleikkausten tekemiseen, teho-osasto ja riittävän laajasti erikoisalojen ympärivuorokautista päivystystä.
