Clarifying the collection of employee data
Act amending section 4 of the Act on the Protection of Privacy in Working Life
An employer will be able to collect an employee's personal data during an employment relationship without separate consent if the data relates to exercising statutory rights or fulfilling statutory obligations. In other situations, such as recruitment, obtaining data from other sources will still require the employee's consent.

What is proposed
The Act on the Protection of Privacy in Working Life will be amended so that an employer will not need the employee's consent to collect personal data from sources other than the employee when the data collection relates to exercising the employer's statutory rights – such as the right to direct and supervise work – or statutory obligations. However, data must still primarily be collected directly from the employee.
What it means
The amendment applies to all employers and employees in both the private and public sectors. Employers will be able to utilise data needed during the employment relationship – for example in supervising work, customer feedback and internal whistleblowing channels – without a formal consent process, reducing administrative burden and legal uncertainty for employers. The scope of processed personal data will not expand, as the data must continue to be directly necessary for the employment relationship.

Key points of the debate
The debate addressed the collection of an employee's personal data during employment without separate consent to carry out statutory obligations. The proposal was considered necessary to align legislation with the EU General Data Protection Regulation, but it also raised doubts about the necessity of the regulation and whether it would increase ambiguity. The proposal was contentious due to concerns raised by labour market organisations and the opposition.
- Does the legislative amendment clarify the current situation or does it increase room for interpretation?
- Is the legislative amendment necessary at all?
- Social DemocratsIn favour
The proposal clarifies unclear and contradictory legislation in relation to the EU General Data Protection Regulation and takes into account real workplace practices where genuine consent cannot always be given.
”Itse ajattelen, että perusteet tälle muutokselle ovat olemassa: selkeä tarve muuttaa epäselvää lainsäädäntöä ja selkeyttää ei niin yhdenmukaista käytäntöä.”
— Katja Taimela - National Coalition PartyIn favour with reservations
The group questioned the necessity of the proposal, citing critical statements from both employer and employee organisations, and feared the regulation would only complicate matters.
”Itselleni ainakin on edelleen epäselvää, miksi tämä esitys ylipäätään olisi todella tarpeellinen.”
— Jaana Pelkonen - Finns PartyIn favour with reservations
Background checks in specific roles were seen as important, but the group considered the regulation too generic and questioned the necessity of the proposal based on concerns raised by employee organisations.
”Näin ollen työntekijä‑ ja työnantajapuolen näkemykset esitetyn sääntelyn tarpeellisuudesta ovat täysin päinvastaisia, ja on hyvin epäselvää, mihin muutosta todella tarvitaan.”
— Ari Koponen

Eduskunnan päätöksen mukaisesti muutetaan yksityisyyden suojasta työelämässä annetun lain (759/2004) 4 §:n 1 momentti, sellaisena kuin se on laissa 347/2019, seuraavasti:
4 §Työntekijän henkilötietojen keräämisen yleiset edellytykset ja työnantajan tiedonantovelvollisuus
Työnantajan on kerättävä työntekijää koskevat henkilötiedot ensi sijassa työntekijältä itseltään. Tietojen keräämiseen muualta kuin työntekijältä itseltään sovelletaan, mitä tietosuoja-asetuksessa säädetään suostumukseen perustuvasta käsittelystä. Tietosuoja-asetuksessa suostumukseen perustuvasta käsittelystä säädettyä ei kuitenkaan sovelleta, jos työnantaja kerää henkilötietoja työsuhteen aikana työnantajalle laissa säädettyjen oikeuksien tai velvollisuuksien toteuttamista varten taikka jos henkilötietojen käsittelystä laissa erikseen toisin säädetään. Turvallisuusselvityksen hakemisesta säädetään turvallisuusselvityslaissa (726/2014). Menettelystä, jolla alaikäisten kanssa työskentelemään valittavien henkilöiden rikostaustaa selvitetään, säädetään lasten kanssa työskentelevien rikostaustan selvittämisestä annetussa laissa (504/2002). Oikeudesta saada tietoja rikosrekisteristä säädetään rikosrekisterilaissa (770/1993).
