Laki ulkomaalaislain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan ulkomaalaislain (301/2004) 39 §:n 1 momentti, 114 §:n 4 momentti ja 115 §:n 2 momentti, sellaisina kuin niistä ovat 39 §:n 1 momentti ja 114 §:n 4 momentti laissa 549/2010, seuraavasti:
39 §Toimeentuloedellytys oleskelulupaa myönnettäessä
Oleskeluluvan myöntäminen edellyttää, että ulkomaalaisen toimeentulo on turvattu, jollei tässä laissa toisin säädetä. Toimeentuloedellytyksestä voidaan yksittäisessä tapauksessa poiketa, jos siihen on poikkeuksellisen painava syy tai lapsen etu sitä vaatii. Toimeentuloedellytystä ei sovelleta myönnettäessä oleskelulupa 6 luvun perusteella, jollei 114 §:n 4 momentista tai 115 §:n 2 momentista muuta johdu.
114 §Oleskeluluvan myöntäminen kansainvälistä suojelua tai tilapäistä suojelua saaneen perheenjäsenelle
Tässä pykälässä tarkoitetun oleskeluluvan myöntäminen edellyttää, että ulkomaalaisen toimeentulo on turvattu. Toimeentuloedellytystä ei kuitenkaan sovelleta, jos:
1) oleskelulupahakemus perhesiteen perusteella on jätetty kolmen kuukauden kuluessa siitä, kun: a) perheenkokoaja on saanut tiedoksi päätöksen hänelle annetusta turvapaikasta; tai b) perheenkokoaja on saanut tiedoksi päätöksen hyväksymisestään Suomeen pakolaiskiintiössä;
2) perheenkokoajan perhe on muodostettu: a) ennen perheenkokoajan Suomeen tuloa, jos hänelle on annettu turvapaikka; tai b) ennen perheenkokoajan hyväksymistä Suomeen pakolaiskiintiössä; ja
3) perheenyhdistäminen ei ole mahdollista sellaisessa kolmannessa maassa, johon perheenkokoajalla tai perheenjäsenellä on erityisiä siteitä.
115 §Oleskeluluvan myöntäminen kansainvälistä suojelua tai tilapäistä suojelua saaneen muulle omaiselle
Tässä pykälässä tarkoitetun oleskeluluvan myöntäminen edellyttää, että ulkomaalaisen toimeentulo on turvattu. Toimeentuloedellytystä ei kuitenkaan sovelleta, jos oleskelulupa myönnetään Suomeen yksin tulleen alaikäisen lapsen ulkomailla olevalle alaikäiselle sisarukselle, jos sisarukset ovat asuneet yhdessä ja jos heidän vanhempansa eivät ole elossa tai näiden olinpaikka on tuntematon.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Jos päätös kansainvälistä suojelua koskevaan hakemukseen on tehty ennen tämän lain voimaantuloa, sovelletaan turvapaikan saaneen ulkomaalaisen perheenjäsenen oleskelulupahakemukseen ja sen jatkolupahakemukseen tämän lain voimaan tullessa voimassa olleita säännöksiä.
Jos päätös pakolaisen hyväksymisestä Suomeen pakolaiskiintiössä on tehty ennen tämän lain voimaantuloa, sovelletaan hänen perheenjäsenen oleskelulupahakemukseen ja sen jatkolupahakemukseen tämän lain voimaan tullessa voimassa olleita säännöksiä.
