Laki hyvinvointialueiden rahoituksesta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan hyvinvointialueiden rahoituksesta annetun lain (617/2021) 35 §:n 6 momentti, sellaisena kuin se on laissa 292/2023, ja lisätään lakiin uusi 26 a § seuraavasti:
26 a §Laskuvirheen korjaaminen
Poiketen siitä, mitä hallintolain (434/2003) 50 ja 51 §:ssä säädetään virheen korjaamisen edellytyksistä, valtiovarainministeriö voi itse tai hakemuksen perusteella korjata tässä laissa tarkoitetuissa päätöksissä ja päätösten perusteena olevissa tiedoissa olevan laskuvirheen. Muilta osin laskuvirheen korjaamisen sovelletaan, mitä hallintolain 8 luvussa säädetään.
35 §Siirtymätasaus
Edellä 1 momentissa tarkoitettu laskennallisten ja toteutuneiden kustannusten erotus lasketaan vuoden 2022 tasolla. Hyvinvointialueen alueen kuntien toteutuneet kustannukset otetaan huomioon kuntakohtaisesti vuosien 2021 ja 2022 keskiarvoina, jotka korotetaan vuoden 2022 koko maan tasolle. Keskiarvon laskennassa käytetään vuodelta 2021 kuntien Valtiokonttorille toimittamia tilinpäätöstietoja ja vuodelta 2022 kuntien talousarviotietoja. Toteutuneet kustannukset tarkistetaan vuonna 2023 vuoden 2024 rahoituksesta lukien kuntien Valtiokonttorille toimittamien vuoden 2022 palvelukohtaisten tilinpäätöstietojen perusteella. Tarkistuksen yhteydessä kuntien vuosien 2021 ja 2022 tilinpäätöksiin kirjatut takautuvat palkkaharmonisaatiokustannukset sekä merkittävästi toteutuneita kustannuksia vääristävät kunnan yksittäiset tilinpäätöstiedot otetaan huomioon noudattaen kunnan peruspalvelujen valtionosuudesta annetun lain (618/2021) 57 §:n 3 momenttia ja mainitun pykälän 6 momentin nojalla säädettyä.

Tämä laki tulee voimaan päivänä kuuta 20 .
