Laki kirkkolain 6 luvun muuttamisesta
Kirkolliskokouksen ehdotuksen ja eduskunnan päätöksen mukaisesti muutetaan kirkkolain (1054/1993) 6 luvun 23 § sekä 40 §:n otsikko ja 2 momentti, sellaisina kuin ne ovat laissa 1008/2012, sekä lisätään 6 lukuun uusi 24 a ja 52 a § seuraavasti:
6 luku – Henkilöstö
23 §Nimikirjan pitäminen
Työnantaja voi pitää viranhaltijoista ja työntekijöistä nimikirjaa. Tuomiokapituli pitää nimikirjaa hiippakunnan papeista ja lehtoreista.
Nimikirjaan merkittävien tietojen tallettamiseen, käyttämiseen ja poistamiseen sovelletaan nimikirjalakia (1010/1989).
24 a §Tietojen luovuttaminen
Viranhaltijaa tai työntekijää koskevien tietojen luovuttamiseen sovelletaan nimikirjalain 6–9 §:ää.
40 §Virka- ja työvapaa
Viranhaltijalla ja työntekijällä on oikeus saada vapaata työstään kunnallisen luottamustoimen hoitamista varten siten kuin kuntalain (410/2015) 80 ja 81 §:ssä säädetään.
52 a §Työllistymisvapaa ja työnantajan ilmoitusvelvollisuus
Viranhaltijalla on sama oikeus työllistymisvapaaseen kuin työntekijällä työsopimuslain mukaan.
Työnantajan velvollisuus ilmoittaa työ- ja elinkeinotoimistolle viranhaltijan taloudellisista tai tuotannollisista syistä tapahtuvasta irtisanomisesta sekä velvollisuus tiedottaa viranhaltijalle tämän oikeudesta työllistymissuunnitelmaan määräytyy työsopimuslain mukaisesti.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Tämän lain 6 luvun 40 §:n 2 momenttia sovelletaan vuonna 2017 kunnassa valittavan valtuuston toimikauden alusta lukien. Tätä ennen luottamushenkilöihin sovelletaan, mitä tämän lain voimaan tullessa voimassa olleessa 6 luvun 40 §:n 2 momentissa säädetään.
