What is proposed
A new penal provision on denial of a serious international crime will be added to the Criminal Code. Public denial, condonation or gross trivialisation on racist grounds of genocide, a crime against humanity, a crime of aggression or a war crime established by a final decision of a recognised international court will be made a punishable offence. The act may be punished by a fine or up to two years of imprisonment, and corporate criminal liability will also apply.
What it means
The amendment clarifies the legal situation and fulfils EU obligations, strengthening the legal protection of minority groups and individuals targeted by hate speech. The criminalisation will not prevent factual historical, scientific, artistic or journalistic debate. The act is intended to enter into force in autumn 2025.
How Parliament voted

Key points of the debate
The debate addressed making the denial of the Holocaust and other serious international crimes punishable in order to fulfil EU obligations. The bill's objective of combating racism and protecting the memory of the victims of the Holocaust was broadly supported. Disagreement and concern were nonetheless raised regarding the potential impact of the act on freedom of expression and historical research, as well as the impartiality of international courts.
- Does the bill excessively restrict freedom of expression and public debate?
- Are the decisions of international courts sufficiently independent to serve as a basis for criminal liability?
- Does the legislation also give balanced consideration to the crimes of communism and other totalitarian regimes?
- National Coalition PartyIn favour
The group supported the proposal as an important part of anti-racism work and safeguarding social peace. According to the group, the provision is sufficiently precise and does not jeopardise freedom of expression or historical research.
”Tällä muutoksella parannetaan turvallisuutta ja yhteiskuntarauhaa. Vihapuhe ei saa jäädä vastauksettomaksi silloin, kun se uhkaa ihmisarvoa ja demokratiaa.”
— Juha Hänninen - Finns PartyIn favour with reservations
The group supported criminalising the denial of the Holocaust and fulfilling EU obligations, but several MPs expressed concern over the curtailment of freedom of expression and the bias of UN-affiliated courts.
”Holokaustin kieltämisen tuleekin olla rangaistavaa, ehdottomasti. Mutta liittyyhän tähän EU:n määräämään lakimuutoskokonaisuuteen myös huolestuttavia ongelmia.”
— Kaisa Garedew - Christian DemocratsIn favour with reservations
The group considered trivialising the Holocaust morally reprehensible and understood the pressure of the EU directive, but found prohibiting false information by restricting freedom of expression fundamentally problematic.
”Erityisen ongelmallista on se, että myös kansainväliset tuomioistuimet voivat olla poliittisille tai ideologisille vaikutteille alttiita.”
— Päivi Räsänen - Social DemocratsIn favour
The group supported the proposal as a welcome and timely step towards safeguarding the credibility of international criminal law and human rights, while also drawing attention to the sufficiency of investigative resources.
”Yhdyn monien asiantuntijoiden näkemyksiin siitä, että esitys on tervetullut ja ennen kaikkea se on ajankohtainen.”
— Riitta Mäkinen
