Cancelling the expansion of fine conversion

Act repealing the act amending section 1 of the Act on the Imposition of a Fine and a Fixed Fine and the act amending chapter 2 a of the Criminal Code

A previously decided legislative amendment to expand the conversion of unpaid fines into imprisonment is repealed before it enters into force. Cases involving repeat fine recipients will therefore not begin to be processed more extensively in the courts for conversion into imprisonment.

What is proposed

The bill repeals the legislative amendments approved in June 2015, under which cases involving persons who committed at least three fine offences in a year would have been referred to court, making their fines convertible into imprisonment. At the same time, planned relaxations to the fine conversion ratio are cancelled, returning to the previous legislation.

What it means

The current state will remain, and repeat fines imposed by the police will continue not to lead to automatic court proceedings or imprisonment. The solution will bring the state annual savings of 12.4 million euros from 2018 onwards, as costs for the police, courts, the prosecution service and the Criminal Sanctions Agency and the prisoner population will not grow. The act will enter into force on 1 January 2016.

How Parliament voted

The bill passed without a vote – no MP proposed rejecting or amending it in plenary.

Key points of the debate

The debate concerned cancelling the expansion of fine conversion into imprisonment for savings reasons. The government parties considered repealing the previously decided reform necessary due to the weak state of public finances, but hoped for new replacement legislation to tackle repeat offences. The opposition criticised the proposal for erratic lawmaking and weakening legal protection in the retail sector.

  • Was cancelling the expansion of fine conversion justified on savings grounds?
  • Does repealing the reform weaken security in the retail sector and the credibility of the judicial system?
  • National Coalition PartyIn favour with reservations

The National Coalition Party supported the proposal to dismantle an expensive and bureaucratic procedure, but required the swift preparation of replacement and more functional legislation.

    Kari Tolvanen
  • Finns PartyIn favour with reservations

The Finns Party accepted repealing the act due to a lack of appropriations, but considered the situation regrettable and required a new bill to break the cycle of crime.

    Kari Kulmala
  • Centre PartyIn favour with reservations

The Centre Party considered repealing the act to be a necessary savings measure in a difficult economic situation, but hoped the issue would be revisited once the economy improved.

    Eeva-Maria Maijala
  • The Social Democrats opposed repealing the act and criticised the Government for erratic justice policy and weakening the predictability of legislation.

  • The Christian Democrats opposed repealing the expansion of the conversion sentence and considered that the act should have been brought into force to maintain respect for the law.

    Sari Essayah
  • Blue ReformIn favour

Blue Reform justified repealing the act primarily by the need for state fiscal savings and the expense of the reform relative to its impact.

Ehdotus uudistuksen peruuttamisesta ja lakien kumoamisesta johtuu ensi sijassa taloudellisista syistä.
    Jari Lindström

Eduskunnan päätöksen mukaisesti säädetään:

1 §

Tällä lailla kumotaan:

1) laki sakon ja rikesakon määräämisestä annetun lain 1 §:n muuttamisesta (730/2015);

2) laki rikoslain 2 a luvun muuttamisesta (731/2015).

2 §

Tämä laki tulee voimaan päivänä kuuta 20 .

Main content of the bill (official)
Laki on tarkoitettu tulemaan voimaan tammikuun 1 päivänä 2016.
