1.Laki rikoslain 2 c luvun 5 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan rikoslain (39/1889) 2 c luvun 5 §:n 2 – 4 momentti, sellaisina kuin ne ovat laissa 521/2019, seuraavasti:

5 §Ehdonalaisen vapauttamisen määritelmä ja määräytyminen
Määräaikaista vankeusrangaistusta suorittava päästetään ehdonalaiseen vapauteen, jollei 9 §:stä muuta johdu, kun hän on suorittanut rangaistuksestaan kaksi kolmasosaa. Vanki, joka ei ole ennen rikoksen tekemistä suorittanut vankeusrangaistusta vankilassa, päästetään ehdonalaiseen vapauteen, kun rangaistuksesta on suoritettu puolet.
Sen estämättä, mitä 2 momentissa säädetään, päästetään määräaikaista vankeusrangaistusta kahtakymmentäyhtä vuotta nuorempana tehdyn rikoksen perusteella suorittava vanki ehdonalaiseen vapauteen, jollei 9 §:stä muusta johdu, kun hän on suorittanut rangaistuksestaan puolet. Rikoksen kahtakymmentäyhtä vuotta nuorempana tehnyt vanki, joka ei ole ennen rikoksen tekemistä suorittanut vankeusrangaistusta vankilassa, päästetään ehdonalaiseen vapauteen, kun rangaistuksesta on suoritettu yksi kolmasosa.
Edellä 2 ja 3 momentissa tarkoitettujen lievempien määräosien soveltamista ei estä se, että henkilö on ennen rikoksen tekemistä suorittanut vankilassa sakon muuntorangaistusta tai rangaistusta siviilipalveluslain (1446/2007) 74 §:ssä tarkoitetusta siviilipalveluksesta kieltäytymisestä, 75 §:ssä tarkoitetusta siviilipalvelusrikoksesta, 76 §:ssä tarkoitetusta siviilipalveluksesta kieltäytymisestä ylimääräisen palveluksen tai liikekannallepanon aikana tai 77 §:ssä tarkoitetusta siviilipalvelusrikoksesta ylimääräisen palveluksen tai liikekannallepanon aikana taikka asevelvollisuuslain (1438/2007) 118 §:ssä tarkoitetusta asevelvollisuudesta kieltäytymisestä, 120 §:ssä tarkoitetusta poissaolosta kutsunnasta liikekannallepanon aikana, 122 §:ssä tarkoitetusta palveluksen välttämisestä tai 123 §:ssä tarkoitetusta palveluksen välttämisestä liikekannallepanon aikana. Määräosaa laskettaessa päivän osaa ei oteta huomioon. Tämän lain 6 luvun 13 §:n mukainen vapaudenmenetysaika vähennetään edellä mainituista määräosista.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Rikokseen, joka on tehty ennen tämän lain voimaantuloa, ja siitä seuraavan rangaistuksen täytäntöönpanoon sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä.
2.Laki henkilötietojen käsittelystä Rikosseuraamuslaitoksessa annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään henkilötietojen käsittelystä Rikosseuraamuslaitoksessa annettuun lakiin (1301/2021) uusi 15 a § seuraavasti:

Sen lisäksi, mitä 14 §:ssä säädetään Rikosseuraamuslaitoksen virkamiesten oikeudesta käsitellä Rikosseuraamuslaitoksen rekistereissä olevia tietoja, virkamiehillä, joiden virkatehtäviin kuuluu rangaistusajan laskeminen, on oikeus käsitellä 33 §:ssä tarkoitettuun hakemistoon siirrettyjä 6 §:n 1–4 kohdassa tarkoitettuja tietoja, jotka ovat välttämättömiä rangaistusajan laskemiseksi.

Tämä laki tulee voimaan päivänä kuuta 20 .
