What is proposed
The Aliens Act will be amended to include an authorization to specify a binding minimum salary threshold for a residence permit for an employed person by a Government decree, which will set the threshold at 1,600 euros per month. At the same time, the income requirement for part-time work will be clarified so that the salary must always cover at least the minimum level required by the condition regarding previous employment for full-time work (1,399 euros per month in 2024).
What it means
The amendment applies to workers coming from outside the EU and EEA and businesses employing them, particularly in agriculture and horticulture, service sectors and cleaning, where a lot of part-time work is done. To obtain a residence permit, employers must offer sufficient working hours or higher wages to meet the threshold of at least 1,600 euros. The act will mainly enter into force on 1 November 2024, and the new salary threshold will apply to extended permits from 1 February 2025.

Key points of the debate
The debate centred on the 1,600 euros minimum salary threshold to be set for residence permits for employed persons, which aims to ensure earning a living through work and reduce the need for social security. The proposal divided opinion in Parliament: the government parties considered the threshold necessary for public finances and fair terms of employment, while part of the opposition believed it would hamper businesses' access to labour and, due to its inflexibility, lead to unreasonable situations.
- Does a fixed salary threshold of 1,600 euros jeopardise the availability of labour in low-wage sectors and sectors suffering labour shortages?
- Should the salary threshold have room for flexibility based on regional differences or humanitarian situations?
- Should regular updating and index linking of the salary threshold be laid down directly in the act?
- Will the salary threshold effectively prevent work-related exploitation, or is criminalising underpayment needed instead, for instance?
- National Coalition PartyIn favour
The National Coalition Party supports the salary threshold because workers coming to Finland must be able to support themselves on their own salary without public support, and the proposed threshold reconciles subsistence with the availability of labour.
”Osana vastuullista työvoiman maahanmuuttoa tulee varmistaa, että Suomeen töihin tulevat saavat työstä palkkaa, jolla tulee Suomessa toimeen.”
— Arto Satonen - Finns PartyIn favour
The Finns Party considers the proposal important to protect Finnish taxpayers and the labour market, so that immigration does not become the importation of cheap labour burdening public finances.
— Jari Ronkainen - Swedish People's PartyIn favour
The Swedish People's Party supports the proposal as part of the overall package and stresses that Finland continues to have a strong need for international labour to secure future investments and services.
”Jotta suomalaisilla olisi myös jatkossa maailman parhaat julkiset palvelut, me ehdottomasti tarvitaan investointeja, me tarvitaan työvoimaa, me tarvitaan työperäistä maahanmuuttoa.”
— Joakim Strand - Social DemocratsIn favour with reservations
The Social Democrats consider introducing a salary threshold and promoting full-time work a step in the right direction, but demand a clear obligation in the act to update the threshold regularly as well as further measures to eradicate underpayment.
”Me sosiaalidemokraatit kannatamme esityksen perusratkaisua 1 600 euron palkkarajan asettamisesta.”
— Eemeli Peltonen - Centre PartyAgainst
The Centre Party opposes the proposal because a rigid income threshold makes it harder for businesses and enterprises to recruit foreign labour in sectors suffering from severe labour shortages.
”Me keskustan puolesta emme tähän hallituksen esitykseen yhdy.”
— Petri Honkonen - GreensAgainst
The Greens oppose the proposal, as strict regulation that narrows the discretionary powers of the authorities weakens the position of workers, complicates family life and negatively impacts children's rights.
”Valitettavasti hallituksen esitys on kuitenkin monin tavoin puutteellinen ja asettaa useat Suomeen muuttavat ja Suomessa jo asuvat ulkomaalaiset työntekijät kohtuuttomaan asemaan.”
— Inka Hopsu - Left AllianceAgainst
The Left Alliance opposes an inflexible salary threshold because it may prevent the entry of part-time workers and lead to unreasonable situations for families, proposing a general minimum wage act as the solution instead.
— Minja Koskela

Laki ulkomaalaislain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan ulkomaalaislain (301/2004) 71 §:n 3 kohta, 72 ja 72 a §, sellaisina kuin ne ovat 71 §:n 3 kohta ja 72 a § laissa 216/2023 ja 72 § laissa 389/2023, seuraavasti:
71 §Työnteon perusteella myönnettävän oleskeluluvan yleiset edellytykset
Oleskeluluvan myöntäminen työntekoa varten edellyttää, että:
3) ulkomaalaisen toimeentulo on turvattu ansiotyöstä saatavalla tulolla oleskeluluvan voimassaolon ajan siten, että palkka on vähintään työttömyysturvalain (1290/2002) 5 luvun 4 §:n 2 momentissa säädetyn euromäärän suuruinen ja työehtosopimuksen mukainen tai, jos alalla ei ole työehtosopimusta, palkka vastaa vähintään mainitussa momentissa säädettyä euromäärää ja samankaltaisista tehtävistä maksettavaa palkkaa;
72 §Työntekijän oleskelulupa
Ulkomaalaiselle myönnetään hakemuksesta työntekijän oleskelulupa, jonka myöntämistä ennen tulee:
1) selvittää tarkoitettuun työhön sopivan, työmarkkinoilla käytettävissä olevan työvoiman saatavuus kohtuullisessa ajassa ottaen huomioon 72 b §:n mukaiset linjaukset;
2) huolehtia siitä, että työntekijän oleskeluluvan myöntäminen ei estä 1 kohdassa tarkoitetun henkilön työllistymistä;
Edellä 1 momentin 3 kohdassa tarkoitettu palkkaraja on euromääräinen. Palkkaraja tulee asettaa sellaiselle tasolle, että työvoiman maahanmuutto vahvistaa julkista taloutta eikä työvoiman saatavuus vaarannu tarpeettomasti. Huomioon on otettava myös työehtosopimusten mukaiset kokoaikaisen työn vähimmäispalkat. Palkkarajan suuruudesta säädetään valtioneuvoston asetuksella.
72 a §Työ- ja elinkeinotoimiston osapäätös työntekijän oleskelulupahakemukseen
1) selvittää tarkoitettuun työhön sopivan, työmarkkinoilla käytettävissä olevan työvoiman saatavuus kohtuullisessa ajassa ottaen huomioon 72 b §:n mukaiset linjaukset;
2) huolehtia siitä, että työntekijän oleskeluluvan myöntäminen ei estä 1 kohdassa tarkoitetun henkilön työllistymistä;
3) varmistaa, että hakemukseen liitetyt selvitykset ovat 71 §:n 1 ja 2 kohdan mukaiset;
4) varmistaa, että ulkomaalaisen toimeentulo on turvattu 71 §:n 3 kohdan mukaisesti;
Edellä 1 momentin 5 kohdassa tarkoitettu palkkaraja on euromääräinen. Palkkaraja tulee asettaa sellaiselle tasolle, että työvoiman maahanmuutto vahvistaa julkista taloutta eikä työvoiman saatavuus vaarannu tarpeettomasti. Huomioon on otettava myös työehtosopimusten mukaiset kokoaikaisen työn vähimmäispalkat. Palkkarajan suuruudesta säädetään valtioneuvoston asetuksella.
§
Lain 72 §:n 1 momentin 3 kohtaa sovelletaan jatkolupahakemuksiin vasta 1 päivästä helmikuuta 2025.
