Laki terveydenhuollon ammattihenkilöistä annetun lain 23 b §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan terveydenhuollon ammattihenkilöistä annetun lain (559/1994) 23 b §, sellaisena kuin se on laissa 433/2010, seuraavasti:
23 b §Rajattu lääkkeenmäärääminen
Kunnan tai kuntayhtymän järjestämisvastuulle kuuluvassa terveydenhuollon avohoidon toimintayksikössä työskentelevällä sairaanhoitajalla, jolla on riittävä käytännön kokemus ja joka on suorittanut tarvittavan lisäkoulutuksen, on rajattu oikeus määrätä apteekista hoidossa käytettäviä lääkkeitä hoitamalleen potilaalle. Sairaanhoitaja saa määrätä lääkettä silloin, kun kyseessä on potilaan ennalta ehkäisevä hoito, lääkärin määräämän lääkehoidon jatkaminen tai sairaanhoitajan toteamaan hoidon tarpeeseen perustuva lääkehoito (rajattu lääkkeenmäärääminen ).
Rajattu lääkkeenmäärääminen voidaan ottaa käyttöön myös kunnan tai kuntayhtymän järjestämisvastuulle kuuluvissa sopimuksen perusteella tai kunnan tai kuntayhtymän lukuun muulla tavalla hankittavissa terveydenhuollon avohoidon palveluissa.
Rajatun lääkkeenmääräämisen edellytyksenä on kirjallinen määräys, jossa määrätään ne lääkkeet, joita sairaanhoitaja saa määrätä, ja mahdolliset lääkkeiden määräämiseen liittyvät rajoitukset. Kirjallisen määräyksen antaa vastaava lääkäri siinä terveydenhuollon toimintayksikössä, johon sairaanhoitaja on palvelussuhteessa.
Valtioneuvoston asetuksella säädetään 1 momentissa tarkoitetusta lisäkoulutuksesta ja tarvittaessa rajatun lääkkeenmääräämisen edellyttämästä käytännön kokemuksesta. Sosiaali- ja terveysministeriön asetuksella annetaan potilasturvallisuuden varmistamiseksi tarkemmat säännökset lääkkeistä ja tautitiloista, joita rajattu lääkkeenmäärääminen voi koskea. Sosiaali- ja terveysministeriö vahvistaa 3 momentissa tarkoitetun kirjallisen määräyksen kaavan.
