Three-year residence requirement for child home care allowance

Act amending the Act on Child Home Care and Private Care Allowance

Receiving the child home care allowance will require at least three years of residence in Finland, and the allowance will be paid only to a parent who mainly cares for the child themselves. The change will encourage immigrant families to take children to early childhood education and care and to transition into integration services and the labour market.

What is proposed

A residence period in Finland of at least three years after turning 16 will be laid down as a condition for the payment of the child home care allowance, with exceptions made only for custodians under the age of 19 and children under 9 months of age. In addition, the child home care allowance will be restricted only to a parent or custodian who mainly cares for the child themselves, alongside a technical update to the definition of care provider in accordance with the Early Childhood Education and Care Act.

What it means

The act will enter into force on 1 January 2027, and the residence period requirement will apply to persons moving to Finland after its entry into force, affecting families arriving from outside the EU and EEA (in 2030, approximately 2,500 custodians and 2,700 children). If a child is mainly cared for by a person outside the family, such as a grandparent, the family will be able to apply for the private care allowance instead of the child home care allowance. The increase in early childhood education and care expenditure incurred by municipalities will be compensated through central government transfers for basic public services, which at full amount will be approximately 5.3 million euros per year.

Key points of the debate

The debate centred on the proposed three-year residence period for receiving the child home care allowance and on restricting the allowance solely to a custodian who primarily cares for the child themselves. The government parties defended the proposal as a means of promoting the integration and employment of immigrant mothers and strengthening children's participation in early childhood education and care. The proposal was highly contentious, and the opposition parties demanded its rejection, considering it unequal for families, ineffective, and detrimental to families' freedom of choice.

  • Will restricting the child home care allowance promote the employment and integration of immigrants?
  • Does the residence period requirement place children and families in an unequal position?
  • Will the reform narrow families' freedom of choice by excluding grandparents from the allowance?
  • Will the legislative amendment increase public expenditure as early childhood education and care costs rise?
  • The reform will speed up the integration and employment of parents with an immigrant background and promote children's language learning in early childhood education and care. It is a justified act of equality and a measure in line with the Nordic approach to prevent segregation.

The proposal will prevent misuse of the social security system immediately upon arrival in the country and strengthen immigrants' personal responsibility for finding employment and studying the language. At the same time, the group emphasised maintaining the child home care allowance as an important option for Finnish families.

    — Pekka Aittakumpu
  • The child home care allowance should not be weakened solely for immigrants; instead, the allowance should be reformed comprehensively and equally for all families. Merely cutting the benefit will increase poverty among families with children and public costs unless genuine integration and employment services are provided.

”Meidän mielestämme kotihoidon tukea ei pidä rajata vain maahanmuuttajataustaisilta perheiltä, vaan järjestelmää on uudistettava yhdenvertaisesti kaikkien perheiden osalta.”
    — Hanna Laine-Nousimaa
  • The integration goals are good in themselves, but the proposal erodes the child home care allowance and prevents grandparents from serving as children's primary carers. The reform weakens families' freedom of choice and increases bureaucracy as well as early childhood education and care costs.

    — Hilkka Kemppi
  • The proposal places families in an unequal position based on their origin and cuts the income of people in vulnerable positions without evidence of employment impacts. Employment and language skills should be supported by strengthening services, not cutting them.

”Ensinnäkin tässä on jälleen kyse esityksestä, jolla itse asiassa asetetaan ihmiset eriarvoiseen asemaan syntyperän perusteella.”
    — Veronika Honkasalo

2) hoidon tuottajalla varhaiskasvatustoimintaa harjoittavaa yksityistä henkilöä tai yhteisöä, jolla on varhaiskasvatuslain (540/2018) 44 §:n mukainen oikeus harjoittaa yksityistä päiväkotitoimintaa tai joka on tehnyt mainitun lain 44 e §:ssä tarkoitetun ilmoituksen yksityisen perhepäivähoidon harjoittamisesta taikka tukeen oikeutetun vanhemman tai muun huoltajan kanssa lasten varhaiskasvatuksesta työsopimuksen tehnyttä henkilöä, ei kuitenkaan saman kotitalouden jäsentä;

3 §Oikeus kotihoidon tukeen

Jos perheeseen kuuluu adoptiolapsi, tukea maksetaan, kunnes lapsen hoitoon ottamisesta adoptiotarkoituksessa sairausvakuutuslain 9 luvun 5 §:n 3 momentissa tarkoitetuissa tilanteissa on kulunut kaksi vuotta.

§

Tämä laki tulee voimaan päivänä kuuta 20 .

Kotihoidon tukikauteen, jota koskeva oikeus alkaa ennen tämän lain voimaantuloa, sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä.

Tämän lain 3 §:n 2 momentissa säädettyä asumisaikavaatimusta sovelletaan hakijaan, joka on muuttanut Suomeen tämän lain tultua voimaan.

Main content of the bill (official)
Esitys liittyy esitykseen valtion vuoden 2027 talousarvioksi. Ehdotettu laki on tarkoitettu tulemaan voimaan 1.1.2027.
