Laki alkoholilain 17 ja 26 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan alkoholilain (1102/2017) 17 §:n 1 momentti ja 26 §:n 2 momentti seuraavasti:
17 §Alkoholijuomien vähittäismyyntilupa ja sen myöntämisen edellytykset
Käymisteitse valmistetun enintään 8,0 tilavuusprosenttia etyylialkoholia sisältävän ja muulla tavoin valmistetun enintään 5,5 tilavuusprosenttia sisältävän alkoholijuoman vähittäismyyntilupa koskee vähittäismyyntiä yhden vähittäismyyntipaikan sisätiloissa ja se myönnetään:
1) monipuolista valikoimaa päivittäin tarvittavia elintarvikkeita maankäyttö- ja rakennuslaissa (132/1999) tarkoitetussa rakennuksessa muutoin kuin tilapäisesti myyvälle hakijalle, jos alkoholijuomien myynnin osuus elinkeinotoiminnassa ei ole selvästi muiden elintarvikkeiden myynnin osuutta suurempi;
2) 1 kohdassa tarkoitettua elinkeinotoimintaa vakituista tai kausiasutusta palvelevalla lupaviranomaisen hyväksymällä säännöllisellä reitillä kulkevassa myymäläautossa tai -veneessä harjoittavalle hakijalle;
3) anniskeluluvan yhteyteen anniskelussa olevien alkoholijuomien vähittäismyyntiin; määräaikaisen anniskeluluvan tai 20 §:ssä tarkoitetun anniskelualueen yhteyteen vähittäismyyntilupa saadaan kuitenkin myöntää vain sellaiseen useiden alkoholijuomien valmistajien esittelytilaisuuteen, jonka tarkoituksena on esitellä tuotteita kuluttajille;
4) alkoholijuomien valmistuspaikan yhteyteen valmistusluvan haltijalle.
26 §Vähittäismyyntipaikka ja vähittäismyyntiluvan myöntäminen
Jos alkoholiyhtiö hakee 17 §:n 1 momentissa tarkoitettua vähittäismyyntilupaa, lupa voidaan myöntää, jos myyntipaikka täyttää tämän pykälän 1 momentissa säädetyt edellytykset.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Tätä lakia sovelletaan myös tämän lain voimaan tullessa voimassa oleviin vähittäismyyntilupiin.
