What is proposed
The quorate composition of the Supreme Administrative Court will be reduced in matters concerning leave to appeal related to asylum, international protection, and associated residence permits and removals from the country. Cases can be decided by a unanimous composition of two members instead of the previous three, unless the nature of the matter requires a larger composition.
What it means
The change will speed up the processing of asylum seekers' cases and reduce court backlogs as applicant numbers rise. The reform is estimated to bring the state savings of approximately 0.3 million euros in 2016. The act will enter into force on 1 January 2016.

Key points of the debate
The debate addressed deciding on leave to appeal in asylum matters at the Supreme Administrative Court in a smaller judicial composition than before to speed up processing. The proposal's objectives were generally considered necessary, and the committee report was unanimous. However, discussions were raised regarding the preservation of legal protection and whether the right of appeal should be restricted even further.
- Does speeding up processing and reducing the composition endanger the legal protection of applicants?
- Should appeal channels in asylum matters be curtailed even more drastically than proposed?
- National Coalition PartyIn favour
The National Coalition Party considered the reform a very good measure to enhance processing efficiency, improving the legal protection of all parties. At the same time, the group considered the possibility of appeal bans later on.
”Tämä oli hyvin yksimielinen mietintö lakivaliokunnassa.”
— Kari Tolvanen - Finns PartyIn favour
The Finns Party supported the proposal to streamline processing and dismantle regulations. However, the group questioned whether appeal routes and levels of appeal should have been cut even further.
”Olen tyytyväinen suuntaan, johon hallitus tätä vie, mutta kysyn kuitenkin: Onko vauhti riittävä?”
— Jani Mäkelä - Left AllianceIn favour with reservations
The Left Alliance considered speeding up processing a good goal, but expressed serious concern about the realisation of asylum seekers' factual legal protection under a lightened process.
— Anna Kontula - Blue ReformIn favour
The minister who presented the proposal emphasised that lightening the judicial composition will speed up the processing of cases and save costs without endangering applicants' legal protection.
”Tämän vuoksi juuri valituslupakokoonpanoon kuuluvien jäsenten määrällä on merkitystä turvapaikka-asioiden käsittelyaikaan korkeimmassa hallinto-oikeudessa.”
— Jari Lindström

Laki korkeimmasta hallinto-oikeudesta annetun lain 6 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään korkeimmasta hallinto-oikeudesta annetun lain (1265/2006) 6 §:ään, sellaisena kuin se on laissa 892/2015, uusi 4 momentti, jolloin nykyinen 4 momentti siirtyy 5 momentiksi, seuraavasti:
6 §
