1.Laki ydinenergialain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan ydinenergialain (990/1987) 4 § ja muutetaan 69 §:n 2 momentti, sellaisena kuin se on laissa 593/1995, seuraavasti:

Rangaistus ydinräjähderikoksesta, yleisvaaran tuottamuksesta ja törkeästä yleisvaaran tuottamuksesta säädetään rikoslain 34 luvun 6–8 §:ssä.

Tämä laki tulee voimaan päivänä kuuta 20 .
2.Laki rikoslain 34 luvun 6 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään rikoslain (39/1889) 34 luvun 6 §:ään, sellaisena kuin se on laeissa 578/1995, 29/1998 ja 874/2018, uusi 4 momentti seuraavasti:

6 §Ydinräjähderikos
Mitä 1 momentissa säädetään, ei sovelleta ydinräjähteen tuomiseen Suomeen taikka sen kuljettamiseen, toimittamiseen tai hallussapitoon Suomessa, jos teko perustuu Suomen sotilaalliseen puolustamiseen, jota toteutetaan osana Pohjois-Atlantin liiton yhteistä puolustusta tai puolustusyhteistyötä, Pohjois-Atlantin liiton yhteiseen puolustukseen taikka puolustusyhteistyöhön, niitä koskevan päätöksenteko- tai sopimusjärjestelmän mukaisesti.
