1.Laki Digi- ja väestötietovirastosta annetun lain 3 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan Digi- ja väestötietovirastosta annetun lain (304/2019) 3 §:n 2 momentti seuraavasti:
3 §Viraston tehtävät
Digi- ja väestötietovirasto hoitaa digitaalisten palvelujen käytön tukeen ja neuvontaan liittyviä tehtäviä sekä julkisen hallinnon tiedonhallinnan asiantuntijatehtäviä ja palveluja. Näistä tehtävistä säädetään tarkemmin valtioneuvoston asetuksella.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Tällä lailla kumotaan Digi- ja väestötietovirastosta annetun valtioneuvoston asetuksen (53/2020) 2 §.
2.Laki hallinnon yhteisistä sähköisen asioinnin tukipalveluista annetun lain 5 ja 25 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan hallinnon yhteisistä sähköisen asioinnin tukipalveluista annetun lain (571/2016) 5 §:n 1 momentin johdantokappale sekä 25 §:n 1 ja 4 momentti, sellaisina kuin niistä ovat, 5 §:n 1 momentin johdantokappale laissa 649/2022 ja 25 §:n 1 momentti laissa 1314/2019, seuraavasti:
5 §Tukipalvelujen käyttö julkisessa tehtävässä
Seuraavat julkisen hallinnon viranomaiset ovat velvollisia käyttämään 3 §:n 1 momentin 2–4, 7 ja 8 kohdassa tarkoitettuja tukipalveluja sekä asiointivaltuuspalvelusta saatavaa tietoa henkilön toimivallasta laillisena edustajana, kun tukipalvelu on käytettävissä ja kyseistä tukipalvelua vastaavan itsenäisesti hankitun palvelun palvelusopimus on päättynyt, jollei viranomaisen ole teknisistä tai toiminnallisista tai kustannustehokkuuteen taikka tietoturvallisuuteen liittyvistä syistä välttämätöntä käyttää toiminnassaan tai sen osassa muuta palvelua:
25 §Tukipalvelujen kustannukset
Tukipalvelujen tuottamisesta aiheutuvat kustannukset katetaan valtion varoista ja tukipalvelun käyttö on käyttäjäorganisaatiolle maksutonta pois lukien 3 §:n 1 momentin 4–6 ja 8 kohdassa tarkoitettujen tukipalvelujen käyttö, josta palvelutuottaja perii käyttäjäorganisaatiolta maksun. Mainitun momentin 4 ja 6 kohdassa tarkoitettujen tukipalvelujen käytöstä julkisoikeudelliseen tarpeeseen voidaan maksu kuitenkin jättää perimättä:
1) viranomaisilta;
2) valtioelimiltä;
3) julkista hallintotehtävää hoitavilta, joiden toiminta merkittävässä määrin rahoitetaan valtion varoista;
4) kunnan, kuntayhtymän, hyvinvointialueen tai hyvinvointiyhtymän yksin tai yhdessä suoraan tai välillisesti täysin omistamilta yhteisöiltä sekä mainittujen yksin tai yhdessä perustamilta säätiöiltä.
Valtiovarainministeriön asetuksella annetaan tarkemmat säännökset niistä käyttäjäorganisaatioista, joilta maksu 1 momentin perusteella jätetään perimättä. Maksuihin sovelletaan muutoin, mitä valtion maksuperustelaissa (150/1992) säädetään.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
