Laki työturvallisuuslain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan työturvallisuuslain (738/2002) 52 b §:n 5 momentti, sellaisena kuin se on laissa 364/2013, sekä muutetaan 10 §:n 1 momentti, 30 §:n 1 momentti ja 40 a §:n 3 momentti, sellaisina kuin niistä ovat 10 §:n 1 momentti laissa 329/2013 ja 40 a §:n 3 momentti laissa 927/2017, seuraavasti:
10 §Työn vaarojen selvittäminen ja arviointi
Työnantajan on työn ja toiminnan luonne huomioon ottaen riittävän järjestelmällisesti selvitettävä ja tunnistettava työstä, työajoista, työtilasta, muusta työympäristöstä ja työolosuhteista aiheutuvat haitta- ja vaaratekijät sekä, jos niitä ei voida poistaa, arvioitava niiden merkitys työntekijöiden turvallisuudelle ja terveydelle. Tällöin on otettava huomioon:
1) tapaturman ja muu terveyden menettämisen vaara kiinnittäen huomiota erityisesti kyseisessä työssä tai työpaikassa esiintyviin 5 luvussa tarkoitettuihin vaaroihin ja haittoihin;
2) esiintyneet tapaturmat, ammattitaudit ja työperäiset sairaudet sekä vaaratilanteet;
3) työntekijän ikä, sukupuoli, ammattitaito ja muut hänen henkilökohtaiset edellytyksensä;
4) työn kuormitustekijät;
5) työajan ulkopuolella tapahtuva työhön liittyvä matkustaminen;
6) mahdollinen lisääntymisterveydelle aiheutuva vaara;
7) muut vastaavat seikat.
30 §Yötyö
Yötyötä tekevälle työntekijälle on tarvittaessa järjestettävä mahdollisuus työtehtävien vaihtamiseen tai siirtymiseen päivätyöhön, jos tämä on olosuhteet huomioon ottaen mahdollista ja työtehtävien vaihtaminen on työntekijän henkilökohtaiset ominaisuudet huomioon ottaen tarpeellista työpaikan olosuhteiden tai työn luonteen työntekijän terveydelle aiheuttaman vaaran torjumiseksi. Jos tämä ei ole mahdollista, työnantajan on selvitettävä, voidaanko työn kuormitustekijöitä vähentää muilla toimenpiteillä. Työntekijälle on pyydettäessä selvitettävä seikkoja, joiden vuoksi työtehtävien vaihtaminen tai siirtyminen päivätyöhön ei ole mahdollista.
40 a §Luettelo biologisille tekijöille altistuneista työntekijöistä
Työsuojeluviranomaisella, työterveyshuollolla, kunnan tartuntataudeista vastaavalla lääkärillä, sairaanhoitopiirin tartuntataudeista vastaavalla lääkärillä ja työsuojeluhenkilöstöllä on oikeus saada luettelo nähtäväkseen.
