Laki vanhusasiavaltuutetusta
Eduskunnan päätöksen mukaisesti säädetään:
1 §Vanhusasiavaltuutettu
Ikääntyneiden aseman parantamiseksi ja oikeuksien edistämiseksi yhdenvertaisuusvaltuutetun toimiston yhteydessä on vanhusasiavaltuutettu.
Vanhusasiavaltuutettu on toiminnassaan itsenäinen ja riippumaton.
2 §Nimittäminen ja kelpoisuusvaatimukset
Vanhusasiavaltuutetun nimittää valtioneuvosto enintään viideksi vuodeksi kerrallaan. Vanhusasiavaltuutetuksi nimitetty vapautuu hoitamasta muuta virkaa siksi ajaksi, jonka hän toimii valtuutettuna.
Vanhusasiavaltuutetun kelpoisuusvaatimuksena on virkaan soveltuva ylempi korkeakoulututkinto, hyvä perehtyneisyys perus- ja ihmisoikeuksiin ja viran tehtäväalaan sekä käytännössä osoitettu johtamistaito.
3 §Tehtävät
Vanhusasiavaltuutetun tehtävänä on edistää ikääntyneiden oikeuksien toteutumista.
Tehtävässään vanhusasiavaltuutetun tulee:
1) seurata ja arvioida ikääntyneiden asemaa ja oikeuksien toteutumista;
2) seurata lainsäädäntöä ja yhteiskunnallista päätöksentekoa sekä arvioida niiden vaikutuksia ikääntyneisiin;
3) tehdä aloitteita, antaa lausuntoja sekä osallistua yhteiskunnalliseen keskusteluun;
4) laatia ja teettää selvityksiä sekä julkaista raportteja;
5) edistää tiedotusta ja välittää ikääntyneitä koskevaa tietoa;
6) edistää yhteistyötä ikääntyneiden asioita käsittelevien sekä ikääntyneitä edustavien toimijoiden välillä.
4 §Oikeus saada tietoja
Vanhusasiavaltuutetulla on oikeus saada muilta viranomaisilta maksutta tehtäviensä hoidon kannalta tarpeellisia tietoja, jollei salassapitosäännöksistä muuta johdu.
5 §Kertomukset
Vanhusasiavaltuutettu antaa valtioneuvostolle vuosittain kertomuksen toiminnastaan.
Vanhusasiavaltuutettu antaa lisäksi eduskunnalle kerran neljässä vuodessa kertomuksen ikääntyneiden asemasta ja oikeuksien toteutumisesta.
6 §Henkilöstö
Vanhusasiavaltuutetulla on tarpeellinen määrä valtuutetun tehtäväalaan perehtyneitä esittelijöitä ja muuta henkilöstöä.
Vanhusasiavaltuutettu nimittää ja ottaa palvelukseen 1 momentissa tarkoitetun henkilöstön.
7 §Työjärjestys
Vanhusasiavaltuutettu hyväksyy toiminnalleen työjärjestyksen.
8 §Voimaantulo
Tämä laki tulee voimaan päivänä kuuta 20 .
