Laki liikenteen palveluista annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään liikenteen palveluista annettuun lakiin (320/2017) uusi 137 a § seuraavasti:
137 a §Tavaraliikenteen ohjaus- ja hallinta Suomen ja Venäjän välisillä maantieraja-asemilla
Tieliikenteen ohjaus- ja hallintapalvelun tarjoaja voi tarjota 137 §:n mukaista liikenteen ohjaus- ja hallintapalvelua Suomen ja Venäjän välisille maantieraja-asemille saapuvan tavaraliikenteen ja sen tullitoimenpiteiden ja rajatarkastuksen suorittamiseksi ja niiden sujuvuuden varmistamiseksi. Tarjotessaan näitä palveluja palveluntarjoaja voi rekisterinpitäjänä käsitellä asiaan liittyviä seuraavia henkilötietoja:
1) ajoneuvon rekisteritunnus, muu yksilöivä tunniste ja rekisteröintimaa;
2) kuljettajan etu- ja sukunimi, puhelinnumero ja sähköpostiosoite;
3) tieto rajanylitystä koskevan varauksen tekemisen ajankohdasta;
4) pysäköintialueelle saapumisen ajankohta ja sieltä poistumisen ajankohta;
5) rajanylityspaikalta poistumisen ajankohta; ja
6) lokitiedot.
Tieliikenteen ohjaus- ja hallintapalvelun tarjoaja voi käyttää järjestelmää, joka tunnistaa ajoneuvon rekisteritunnuksen tai muun yksilöivän tunnisteen automaattisesti. Automaattista tunnistusta saa tehdä vain rajanylityspaikalla ja sen läheisyydessä olevalla pysäköintialueella. Tietojärjestelmään talletetut henkilötiedot on poistettava ajoneuvon poistuttua rajanylityspaikalta.
Tietojärjestelmään talletetut tiedot on luovutettava maksutta Tullille ja Rajavartiolaitokselle teknisen käyttöyhteyden avulla tai muutoin sähköisesti. Avoimen rajapinnan kautta luovutettavista tiedoista säädetään 146 §:ssä ja salassa pidettävien tietojen luovuttamisesta 147 §:ssä.
Palvelun tarjoajan ja sen toteuttajan palveluksessa olevaan henkilöön sovelletaan rikosoikeudellista virkavastuuta koskevia säännöksiä hänen suorittaessaan tässä pykälässä tarkoitettuja tehtäviä. Vahingonkorvausvastuusta säädetään vahingonkorvauslaissa (412/1974).

Tämä laki tulee voimaan päivänä kuuta 20 .
