Laki työaikalain muuttamisesta
Eduskunnan päätöksen mukaisesti lisätään työaikalakiin (872/2019) uusi 8 a § ja 34 §:n 2 momenttiin uusi 2 a kohta seuraavasti:
8 a §Yötyötä tekevän työntekijän oikeus työmatkakuljetukseen
Työnantajan on järjestettävä yötyötä tekevän työntekijän työmatkakuljetus, jos:
1) työmatka edellyttää kuljetusta ja on paikkakunnalla tavanomainen; 2) työvuoron alkamis- tai päättymisaikana ei ole reitiltään tai aikataulultaan tyydyttävää julkista liikennettä; ja 3) työntekijällä ei ole käytettävissään autoa tai siihen verrattavaa kulkuneuvoa.
Oikeutta työmatkakuljetukseen ei kuitenkaan ole, jos työntekijä ei voi käyttää autoa hänelle rikoksen tai rikkomuksen johdosta määrätyn ajokiellon vuoksi.
Työnantaja voi periä työntekijältä työmatkakuljetuksesta julkisen liikennevälineen käytöstä suoritettavaa maksua vastaavan korvauksen.
Työnantajan on ennen työmatkakuljetuksen järjestämistä koskevan päätöksen tekemistä neuvoteltava asiasta henkilöstön kanssa.
34 §Poikkeaminen työehtosopimuksella
Valtakunnalliset työnantajien ja työntekijöiden yhdistykset saavat työehtosopimuksessa (valtakunnallinen työehtosopimus ) sopia toisin siitä, mitä tässä laissa säädetään:
2 a) 8 a §:ssä yötyötä tekevän työntekijän oikeudesta työmatkakuljetukseen;
