Laki kunnan peruspalvelujen valtionosuudesta annetun lain muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan kunnan peruspalvelujen valtionosuudesta annetun lain (618/2021) 21 §:n 1 momentti, 32 §, 47 § ja 57 §:n 4 momentti, sellaisina kuin niistä ovat 21 §:n 1 momentti, 32 § ja 57 §:n 4 momentti laissa 1183/2022, seuraavasti:
21 §Valtionosuusprosentti ja kunnan omarahoitusosuus
Kunnan 6–12 §:ssä tarkoitetut laskennalliset kustannukset jakautuvat siten, että kuntien valtionosuus on 21,92 prosenttia ( valtionosuusprosentti ) ja kuntien omarahoitusosuus on 78,08 prosenttia.
32 §Määräaikaiset kuntien valtionosuuteen kohdistuvat vähennykset ja lisäykset
Vuonna 2024 kunnan peruspalvelujen valtionosuuteen lisätään 34,70 euroa asukasta kohden 57 §:n 4 momentissa tarkoitetusta sosiaali- ja terveydenhuollon ja pelastustoimen uudistuksen rahoituksen siirron tarkistamisesta vuodelle 2024 johtuen.
Vuosina 2025–2027 kunnan peruspalvelujen valtionosuudesta vähennetään 11,57 euroa asukasta kohden 1 momentissa tarkoitetun lisäyksen johdosta.
47 §Laskuvirheen korjaaminen
Poiketen siitä, mitä hallintolain (434/2003) 50 ja 51 §:ssä säädetään virheen korjaamisen edellytyksistä, valtiovarainministeriö voi itse tai hakemuksen perusteella korjata tässä laissa tarkoitetuissa päätöksissä ja päätösten perusteena olevissa tiedoissa olevan laskuvirheen. Muilta osin laskuvirheen korjaamiseen sovelletaan, mitä hallintolain 8 luvussa säädetään.
57 §Voimaantulo
Sosiaali- ja terveydenhuollon ja pelastustoimen järjestämisvastuun siirron vuoksi kunnilta hyvinvointialueille siirrettävät tulot tarkistetaan vuoden 2022 tilinpäätöstietojen ja verotulojen osalta valmistuneen verotuksen mukaisten maksuunpantujen verotulojen perusteella koko maan tasolla hyvinvointialueille siirtyviä kustannuksia vastaaviksi. Tulojen ja kustannusten erotus otetaan huomioon peruspalvelujen valtionosuudessa vuodesta 2024 lukien. Jos kunnilta on tarkistuksen perusteella koko maan tasolla siirtynyt tuloja vähemmän kuin kustannuksia, erotusta vastaava määrä vähennetään kunnille myönnettävästä valtionosuudesta. Jos tuloja on siirtynyt enemmän kuin kustannuksia, erotusta vastaava määrä lisätään kunnille myönnettävään valtionosuuteen. Vähennys tai lisäys otetaan huomioon valtionosuudessa kaikissa kunnissa asukasta kohti yhtä suurena eränä. Vastaavasti vuoden 2023 osalta erotuksesta otetaan huomioon jälkikäteen valtionosuuden lisäyksenä tai vähennyksenä vuosina 2025–2027 kunakin vuonna yksi kolmasosa.
