Laki vammaispalvelulain 2 §:n muuttamisesta
Eduskunnan päätöksen mukaisesti muutetaan vammaispalvelulain (675/2023) 2 §, sellaisena kuin se on osaksi laissa 1075/2024, seuraavasti:
2 §Lain soveltamisala ja suhde muuhun lainsäädäntöön
Tässä laissa säädetään vammaisille henkilöille järjestettävistä erityispalveluista, jäljempänä vammaispalvelut .
Vammaisella henkilöllä tarkoitetaan tässä laissa henkilöä, joka tarvitsee vamman tai sairauden aiheuttaman pitkäaikaisen fyysisen, kognitiivisen, psyykkisen, sosiaalisen tai aisteihin liittyvän toimintarajoitteen johdosta välttämättä apua tai tukea tavanomaisessa elämässä.
Vammaisen henkilön palvelut järjestetään ensisijaisesti sosiaalihuoltolain (1301/2014), terveydenhuoltolain (1326/2010), ikääntyneen väestön toimintakyvyn tukemisesta sekä iäkkäiden sosiaali- ja terveyspalveluista annetun lain (980/2012), varhaiskasvatuslain (540/2018), perusopetuslain (628/1998) tai muun ensisijaisen lain perusteella.
Tämän lain perusteella järjestetään palveluita niille vammaisille henkilöille, joiden toimintarajoitteesta johtuva välttämätön avun ja tuen tarve poikkeaa kyseessä olevaan elämänvaiheeseen tavanomaisesti kuuluvasta avun ja tuen tarpeesta. Tässä laissa tarkoitetaan elämänvaiheella ihmisen yleiseen elämänkulkuun kuuluvaa ajanjaksoa, johon liittyy sille tyypillisiä kehitysvaiheita ja tehtäviä. Elämänvaiheita ovat lapsuus, nuoruus, aikuisuus ja vanhuus. Arvioitaessa oikeutta saada vammaispalveluita eri elämänvaiheissa tulee ottaa huomioon, mitä 1 §:ssä säädetään lain tarkoituksesta. Arvioinnissa tulee lisäksi ottaa huomioon palveluiden jatkuvuus siirryttäessä elämänvaiheesta toiseen. Arviointi tulee tehdä osana yksilöllistä palvelutarpeen arviointiprosessia.
Tämän lain perusteella järjestetään palveluita vain, jos muussa laissa tarkoitetut palvelut eivät ole vammaisen henkilön yksilöllisen palvelutarpeen ja edun kannalta sopivia ja riittäviä. Asiakkaan edusta säädetään sosiaalihuoltolain 4 ja 5 §:ssä.
Ensisijaisen lainsäädännön mukaan järjestettävistä sosiaali- ja terveydenhuollon palveluista voidaan periä maksu sosiaali- ja terveydenhuollon asiakasmaksuista annetun lain (734/1992) mukaisesti. Sen lisäksi, mitä mainitun lain 11 §:ssä säädetään maksun perimättä jättämisestä tai määrätyn maksun alentamisesta, 3 momentissa mainitun lain perusteella järjestetyistä sosiaali- ja terveydenhuollon palveluista määrättävä maksu on jätettävä määräämättä tai perimättä tai sitä on alennettava, jos maksu estää vammaisen henkilön palveluiden yksilöllisen järjestämisen tai vaikeuttaa sitä olennaisesti tai jos siihen on syytä huollolliset näkökohdat huomioon ottaen.
Palveluiden järjestämisvastuusta säädetään hyvinvointialueesta annetussa laissa (611/2021), sosiaali- ja terveydenhuollon järjestämisestä annetussa laissa (612/2021), jäljempänä järjestämislaki , ja sosiaali- ja terveydenhuollon sekä pelastustoimen järjestämisestä Uudellamaalla annetussa laissa (615/2021).
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Tämän lain voimaan tullessa vireillä olleet hakemukset käsitellään noudattaen tämän lain voimaan tullessa voimassa olleita säännöksiä. Tämän lain voimaan tullessa vireillä ollut muutoksenhakuasia käsitellään loppuun noudattaen tämän lain voimaan tullessa voimassa olleita säännöksiä. Vuoden 2025 aikana tämän lain voimaan tullessa voimassa olleiden säännösten perusteella tehdyt päätökset pysyvät voimassa niiden voimassaoloajan. Päätökset tulee saattaa tämän lain mukaisiksi vammaisen henkilön aloitteesta tai hyvinvointialueen aloitteesta silloin, kun vammaisen henkilön palvelutarve sitä edellyttää.
