Easing dismissal criteria and waiting periods

Acts amending Chapter 7, Section 2 of the Employment Contracts Act and Chapter 2 a, Section 1 of the Unemployment Security Act

When assessing grounds for dismissing an employee, the number of employees of the employer will be taken into account, facilitating dismissals particularly in small businesses. At the same time, the unemployment benefit waiting period following the termination of an employment relationship for reasons attributable to the employee will be shortened from 90 days to 60 days.

What is proposed

The Employment Contracts Act will be amended so that the overall assessment of personal grounds for dismissal explicitly takes into account the number of employees of the employer as well as the overall circumstances of the employer and employee, in order to consider small businesses' lesser capacity to tolerate breaches of duty or a lack of trust. In the Unemployment Security Act, the period without compensation, or waiting period, following dismissal or cancellation of employment during a trial period resulting from the employee's own conduct will be shortened from 90 days to 60 days across all enterprises.

What it means

The amendments will enter into force on 1 July 2019. The dismissal provision will lower the threshold for hiring by small employers and is estimated to affect up to 68,000 enterprises with fewer than 10 employees and approximately 270,000 permanent wage earners. Shortening the waiting period will affect an estimated 10,200 unemployed jobseekers per year and increase public unemployment security expenditure by approximately 11 million euros per year (the central government share being approximately 6.8 million euros).

Key points of the debate

The debate focused on easing dismissal criteria for small employers and shortening the unemployment waiting period following a dismissal attributable to the employee. The government parties and the Christian Democrats considered that the legislative amendment would lower the threshold for small businesses to hire employees. The rest of the opposition opposed weakening dismissal protection, considering the bill unclear, devoid of employment effects and likely to increase legal uncertainty.

  • Will facilitating dismissal lower the recruitment threshold for small enterprises?
  • Will the proposed amendment to the section cause prolonged uncertainty and interpretive problems in judicial practice?
  • Should the unemployment waiting period also be shortened for employees who resign on their own initiative?
  • The group considered the reform an important way to encourage small business owners to hire and to support labour market dynamics.

”Tämä on tärkeä uudistus, jolla pienyrittäjien työllistämismahdollisuutta tuetaan.”
    — Ben Zyskowicz
  • Blue ReformIn favour

The group considered that taking company size into account in the grounds for dismissal lowers the recruitment threshold and takes into account a small employer's weaker capacity to withstand disruptions in the workplace community.

”Tämän esityksen tavoitteena on madaltaa työnantajan työllistämiskynnystä.”
    — Jari Lindström
  • The group called for the weakening of dismissal protection to be rejected, as the act leaves employers and employees in a state of uncertainty due to its interpretation and shifts legislative power to the courts.

”Kun muutettua irtisanomisperustetta aletaan yrityksissä soveltaa, säädökset eivät anna riittävästi tulkintalinjaa, vaan se on haettava tuomioistuimista.”
    — Rami Lehto
  • The group opposed weakening dismissal protection, stating that the proposal has no employment effects supported by research evidence and creates uncertainty in the labour market.

”Tämän lain seurauksena työmarkkinoille syntyy monen vuoden epätietoisuuden aika, kun odotetaan oikeuden ratkaisuja siitä, miten tätä epäselvää lakia käytännössä sovelletaan.”
    — Merja Mäkisalo-Ropponen
  • GreensAgainst

The group considered the act confused and an ineffective measure in terms of employment, proposing instead that hiring be facilitated through advisory services and pay subsidies.

    — Krista Mikkonen
  • The group considered the proposal ineffective in relation to its objectives, weakening employees' legal protection and undermining legal certainty for years.

”Tältä pohjalta minä en näe mahdolliseksi tulkita tätä lakia mitenkään muuten kuin puhtaana kasvojen säilyttämislakina ja poikkeuksellisen kalliina sellaisena.”
    — Anna Kontula
  • The group considered the bill a good and necessary change that helps lower the threshold for small enterprises to hire permanent employees.

1) 90 päivän ajalta työsuhteen päättymisen jälkeen, jos hän on ilman pätevää syytä eronnut työstään;

2) 60 päivän ajalta työsuhteen päättymisen jälkeen, jos hän on itse aiheuttanut työsuhteen päättymisen;

§

Tämä laki tulee voimaan päivänä kuuta 20 .

Main content of the bill (official)
Esityksen tavoitteena on madaltaa pienten työnantajien työllistämiskynnystä. Työttömyysturvalakia muutettaisiin siten, että työsuhteen päättymisen perusteella asetettavaa korvauksetonta määräaikaa lyhennettäisiin nykyisestä 90 päivästä 60 päivään tilanteissa, joissa työnantaja on päättänyt työsuhteen työntekijästä johtuvasta syystä. Lait on tarkoitettu tulemaan voimaan 1 päivänä heinäkuuta 2019.
