Laki vuorotteluvapaalain muuttamisesta
Eduskunnan päätöksen mukaisesti kumotaan vuorotteluvapaalain (1305/2002) 3 §:n 4 kohta, sellaisena kuin se on laissa 1127/2007, sekä muutetaan 4 §:n 1 momentti, 6 ja 7 § sekä 15 §:n 1 momentti, sellaisina kuin ne ovat 4 §:n 1 momentti, 6 § ja 7 § laissa 659/2014 sekä 15 §:n 1 momentti laissa 1191/2009, seuraavasti:
4 §Vuorotteluvapaan työhistoriaedellytys
Vuorotteluvapaan edellytyksenä on, että henkilö on hankkinut työssäoloaikaa ennen vuorotteluvapaan alkamista vähintään 20 vuotta. Jos henkilö on aiemmin saanut vuorottelukorvausta, työssäoloaikaa on oltava vähintään viisi vuotta edellisen vuorotteluvapaan päättymisestä. Työssäoloaika lasketaan työntekijän eläkelain (395/2006) 3 §:ssä tarkoitettujen työeläkelakien alaisten ansioiden perusteella.
6 §Vuorotteluvapaan kesto
Vuorotteluvapaan kesto on vähintään 100 kalenteripäivää ja enintään 180 kalenteripäivää.
7 §Sovitun vuorotteluvapaan pidentäminen
Vuorotteluvapaan pidentämisestä on sovittava kaksi kuukautta ennen sovitun vuorotteluvapaan päättymistä.
15 §Vuorottelukorvauksen suuruus
Vuorottelukorvauksen täysi määrä on 70 prosenttia siitä työttömyyspäivärahasta, johon henkilöllä olisi työttömänä ollessaan oikeus työttömyysturvalain 5 luvun 2—5 §:n sekä 6 luvun 1 §:n 1 momentin, 2 §:n 1 momentin ja 4 §:n perusteella. Vuorottelukorvausta määriteltäessä ei työttömyysturvalain 6 luvun 6 §:ssä tarkoitettua lapsikorotusta oteta huomioon.
§
Tämä laki tulee voimaan päivänä kuuta 20 .
Jos vuorottelija on aloittanut vuorotteluvapaan tai sen jakson ennen tämän lain voimaantuloa, mutta vuorotteluvapaata ei ole pidetty kokonaan tämän lain voimaan tullessa, vuorotteluvapaaseen sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä.
Jos vuorottelija on tehnyt vuorottelusopimuksen ennen tämän lain voimaantuloa ja aloittaa vuorotteluvapaan viimeistään 31 päivänä maaliskuuta 2016, vuorotteluvapaaseen sovelletaan tämän lain voimaan tullessa voimassa olleita säännöksiä.
