What is proposed
The entry into force of the obligation to record personnel data in the national database for early childhood education and care (Varda) will be laid down by government decree instead of an act. In addition, an unnecessary provision on recording data separately for purchased service and service voucher places will be repealed.
What it means
The change applies to municipalities, joint municipal authorities and IT system providers, for whom postponing the obligation to record municipal early childhood education and care personnel data from 1 September 2019 to 1 September 2020 will provide additional time to prepare system integrations and data transfers. The act will enter into force in autumn 2019.

Key points of the debate
There was broad consensus in the debate that it is necessary to postpone the registration of early childhood education and care personnel data in the database by one year due to IT challenges. The main concern focused on the proposed power for the Government to lay down further schedules by decree instead of Parliament. In addition, the opposition used the opportunity to ask about the Government's broader policies and funding on early childhood education and care.
- Can the schedule for introducing the database be laid down by decree without Parliament?
- Centre PartyIn favour
Extending the transition period prevents municipalities from being overburdened and provides the necessary time to create a high-quality data collection system.
”Pidän tätä hallituksen esitystä erittäin kannatettavana.”
— Hilkka Kemppi - Left AllianceIn favour
An extra year is essential so that municipalities and system providers have time to resolve the extensive IT challenges and ensure data protection.
”Esitys siis antaisi kunnille riittävän ajan valmistautua huolella tietojärjestelmän käyttöönottoon ja helpottaisi kuntien vastuulla olevien tietojärjestelmäintegraatioiden toteuttamista.”
— Li Andersson - National Coalition PartyIn favour with reservations
Extending the transition period is considered justified, but the proposed power to issue decrees was criticised for bypassing Parliament and for constitutional problems.
”Itse pidän sitä vähän ongelmallisena, että annetaan asetuksenanto-oikeus — mehän emme sitten tiedä, mitä kaikkea sillä asetuksella voidaan tehdä.”
— Paula Risikko - Christian DemocratsIn favour with reservations
There are good grounds for postponing the schedule, but the legality of the power to issue decrees should be examined thoroughly in the Constitutional Law Committee.
”Varhaiskasvatuksen henkilöstötietojen tallentamisen käyttöönottoa siis siirretään vuodella eteenpäin, ja tälle ministeri antoi hyvin ymmärrettävät perustelut.”
— Päivi Räsänen
